Commercial Use Limited Warranty
In this warranty, where you see a capitalised term, that capitalised term has the meaning given in our Terms.
Commercial Use Limited Warranty – Australia
In addition to any rights you have at law in Australia and subject to the conditions of this warranty, we offer a limited, non-transferable, warranty on these Items when used in accordance with our Terms:
- defects in component parts, electronic parts and wearable items – for 12 months; and
- defects in consumables, including cables and accessories – for 12 months,
from the date the Item is delivered to you.
If you submit a claim under this limited warranty, we will, at our option:
- replace the defective part, or supply of equivalent part; or
- repair the defective part; or
- pay the costs of replacing the defective part, or acquiring equivalent parts; or
- pay the cost of having the defective part repaired.
This limited warranty only applies to Items that:
- have been used exclusively for a commercial purpose;
- remain in the possession of the original purchaser and at the original site to which the Items were delivered and proof of purchase is demonstrated; and
- are sold and used in Australia.
This limited warranty does not apply to:
- cosmetic damage, including but not limited to scratches and dents;
- damage caused by accident, abuse, misuse or otherwise careless use, fire, liquid contact or other external cause;
- deliberate or wilful damage;
- damage caused by operating the Item other than in accordance with these Terms and any guidelines provided by us;
- damage caused by use with a third party component or product that is not authorised by us;
- damage caused by servicing performed by anyone who is not authorised by us;
- defects caused by normal wear and tear;
- the cost of labour, parts, repairs or replacement outside of Australia; and
- Items that are sold and used outside of Australia.
If we fail to comply with any consumer guarantee or warranty provided for in the Competition and Consumer Act 2010 (Cth) that cannot be excluded in relation to the Products, the following applies if you’re covered by Australian law:
- Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
- For major failures with a service, you are entitled:
-
to cancel your service contract with us; and
-
to a refund for the unused portion, or to compensation for its reduced value.
- You are also entitled to choose a refund or replacement for major failures with goods.
- If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
Subject to paragraphs (a) to (d) immediately above:
- if there is a minor failure and the Item can be repaired or replaced, we will send a repair part or replacement, or refund the purchase price, at our discretion;
- for any Item that we cannot assess ourselves, we may arrange for or have you send the Item directly to the manufacturer for assessment. In these circumstances, depending on the Item, please be aware that it may take several weeks to complete this process;
- if we do not find a fault in the Item, at our discretion the replacement or refund may be refused and the Item returned to you at your cost; and
- if you fail to comply with any of your obligations set out under this clause, including in respect of the return of Item (if required by us, acting reasonably), we reserve, acting reasonably, the right to refuse to provide you with a replacement or refund of the Item in our discretion.

Commercial Use Limited Warranty – USA
In addition to any rights you have at law in the USA and subject to the conditions of this warranty, we offer a limited, non-transferable, warranty on these Items when used in accordance with our Terms:
- defects in component parts, electronic parts and wearable items – for 12 months; and
- defects in consumables, including cables and accessories – for 12 months,
from the date the Item is delivered to you.
If you submit a claim under this limited warranty, we will, at our option:
- replace the defective part, or supply of equivalent part;
- repair the defective part;
- pay the costs of replacing the defective part, or acquiring equivalent parts; or
- pay the cost of having the defective part repaired.
This limited warranty only applies to Items that:
- have been used exclusively for a commercial purpose;
- remain in the possession of the original purchaser and at the original site to which the Items were delivered and proof of purchase is demonstrated; and
- are sold and used in the United States.
This limited warranty does not apply to:
- cosmetic damage, including but not limited to scratches and dents;
- damage caused by accident, abuse, misuse or otherwise careless use, fire, liquid contact or other external cause;
- deliberate or wilful damage;
- damage caused by operating the Item other than in accordance with these Terms and any guidelines provided by us;
- damage caused by use with a third party component or product that is not authorised by us;
- damage caused by servicing performed by anyone who is not authorised by us; and
- defects caused by normal wear and tear;
- the cost of labour, parts, repairs or replacement outside of the USA; and
- Items that are sold and used outside of the USA.
If we fail to comply with any consumer guarantee or warranty required at law in the USA that cannot be excluded in relation to the Products, our liability to you for failure to comply with any such guarantees or warranties is limited to, at our option, one or more of the following:
- the replacement of the Products, or the supply of equivalent Products;
- the repair of the Products;
- the payment of the costs of replacing the Products, or acquiring equivalent Products; or
- the payment of the cost of having the Products repaired.
To the extent permitted by law, (a) this limited warranty modifies and supersedes any implied warranty specified at law and (b) all other guarantees or warranties (whether express or implied) are excluded to the maximum extent permitted – and such guarantees or warranties are limited as set out above. Subject to this, some states do not permit such exclusions or limitations of damages, which may mean that such limitations might not be relevant to you, but, where it applies, our limited warranty provides you with legal rights which may apply in exclusion of or in addition to any other rights you may have at law in that state.

Commercial Use Limited Warranty – Canada
In addition to any rights you have at law in Canada and subject to the conditions of this warranty, we offer a limited, non-transferable, warranty on these Items when used in accordance with our Terms:
- defects in component parts, electronic parts and wearable items – for 12 months; and
- defects in consumables, including cables and accessories – for 12 months,
from the date the Item is delivered to you.
If you submit a claim under this limited warranty, we will, at our option:
- replace the defective part, or supply of equivalent part;
- repair the defective part;
- pay the costs of replacing the defective part, or acquiring equivalent parts; or
- pay the cost of having the defective part repaired.
This limited warranty only applies to Items that:
- have been used exclusively for a commercial purpose;
- remain in the possession of the original purchaser and at the original site to which the Items were delivered and proof of purchase is demonstrated; and
- are sold and used in Canada.
This limited warranty does not apply to:
- cosmetic damage, including but not limited to scratches and dents;
- damage caused by accident, abuse, misuse or otherwise careless use, fire, liquid contact or other external cause;
- deliberate or wilful damage;
- damage caused by operating the Item other than in accordance with these Terms and any guidelines provided by us;
- damage caused by use with a third party component or product that is not authorised by us;
- damage caused by servicing performed by anyone who is not authorised by us;
- defects caused by normal wear and tear;
- the cost of labour, parts, repairs or replacement outside of Canada; and
- Items that are sold and used outside of Canada.
If we fail to comply with any consumer guarantee or warranty required at law in Canada that cannot be excluded in relation to the Products, our liability to you for failure to comply with any such guarantees or warranties is limited to, at our option, one or more of the following:
- the replacement of the Products, or the supply of equivalent Products;
- the repair of the Products;
- the payment of the costs of replacing the Products, or acquiring equivalent Products; or
- the payment of the cost of having the Products repaired.
To the extent permitted by law, (a) this limited warranty modifies and supersedes any implied warranty specified at law and (b) all other guarantees or warranties (whether express or implied) are excluded to the maximum extent permitted – and such guarantees or warranties are limited as set out above. Subject to this, some provinces or territories do not permit such exclusions or limitations of damages, which may mean that such limitations might not be relevant to you, but, where it applies, our limited warranty provides you with legal rights which may apply in exclusion of or in addition to any other rights you may have at law in the province or territory relevant to you.

Commercial Use Limited Warranty – EU
In addition to any rights you have at law in the EU and subject to the conditions of this warranty, we offer a limited, non-transferable, warranty on these Items when used in accordance with our Terms:
- defects in component parts, electronic parts and wearable items – for 12 months; and
- defects in consumables, including cables and accessories – for 12 months,
from the date the Item is delivered to you.
If you submit a claim under this limited warranty, we will, at our option:
- replace the defective part, or supply of equivalent part;
- repair the defective part;
- pay the costs of replacing the defective part, or acquiring equivalent parts; or
- pay the cost of having the defective part repaired.
This limited warranty only applies to Items that:
- have been used exclusively for a commercial purpose;
- remain in the possession of the original purchaser and at the original site to which the Items were delivered and proof of purchase is demonstrated; and
- are sold and used in the EU.
This limited warranty does not apply to:
- cosmetic damage, including but not limited to scratches and dents;
- damage caused by accident, abuse, misuse or otherwise careless use, fire, liquid contact or other external cause;
- deliberate or wilful damage;
- damage caused by operating the Item other than in accordance with these Terms and any guidelines provided by us;
- damage caused by use with a third party component or product that is not authorised by us;
- damage caused by servicing performed by anyone who is not authorised by us;
- defects caused by normal wear and tear; and
- the cost of labour, parts, repairs or replacement outside of the EU; and
- Items that are sold and used outside of the EU.
If we fail to comply with any consumer guarantee or warranty required at law in the EU that cannot be excluded in relation to the Products, our liability to you for failure to comply with any such guarantees or warranties is limited to, at our option, one or more of the following:
- the replacement of the Products, or the supply of equivalent Products;
- the repair of the Products;
- the payment of the costs of replacing the Products, or acquiring equivalent Products; or
- the payment of the cost of having the Products repaired.

Commercial Use Limited Warranty – UK
In addition to any rights you have at law in the UK and subject to the conditions of this warranty, we offer a limited, non-transferable, warranty on these Items when used in accordance with our Terms:
- defects in component parts, electronic parts and wearable items – for 12 months; and
- defects in consumables, including cables and accessories – for 12 months,
from the date the Item is delivered to you.
If you submit a claim under this limited warranty, we will, at our option:
- replace the defective part, or supply of equivalent part;
- repair the defective part;
- pay the costs of replacing the defective part, or acquiring equivalent parts; or
- pay the cost of having the defective part repaired.
This limited warranty only applies to Items that:
- have been used exclusively for a commercial purpose;
- remain in the possession of the original purchaser and at the original site to which the Items were delivered and proof of purchase is demonstrated; and
- are sold and used in the UK.
This limited warranty does not apply to:
- cosmetic damage, including but not limited to scratches and dents;
- damage caused by accident, abuse, misuse or otherwise careless use, fire, liquid contact or other external cause;
- deliberate or wilful damage;
- damage caused by operating the Item other than in accordance with these Terms and any guidelines provided by us;
- damage caused by use with a third party component or product that is not authorised by us;
- damage caused by servicing performed by anyone who is not authorised by us;
- defects caused by normal wear and tear;
- the cost of labour, parts, repairs or replacement outside of the UK; and
- Items that are sold and used outside of the UK.
If we fail to comply with any consumer guarantee or warranty required at law in the UK that cannot be excluded in relation to the Products, our liability to you for failure to comply with any such guarantees or warranties is limited to, at our option, one or more of the following:
- the replacement of the Products, or the supply of equivalent Products;
- the repair of the Products;
- the payment of the costs of replacing the Products, or acquiring equivalent Products; or
- the payment of the cost of having the Products repaired.

Limited Warranty – Other Jurisdictions: If you’re not you’re covered by Australian, US, Canadian, EU or UK law, subject to the laws of the applicable jurisdiction, our liability to you for failure to comply with any guarantees or warranties in relation to the Products is limited to, at our option, one or more of the following:
- the replacement of the Products, or the supply of equivalent Products;
- the repair of the Products;
- the payment of the costs of replacing the Products, or acquiring equivalent Products; or
- the payment of the cost of having the Products repaired.
